PART I: PRIVACY POLICY

1. Who We Are

Publidu LLC d.b.a. Insignia Business Group is a professional bookkeeping and business solutions firm dedicated to maintaining absolute confidentiality over all corporate records, financial data, and client information shared with us through our websites, client portal, and direct communications. Our primary website address is www.publidu.com, and our secondary web property is www.insigniabg.com.

2. Client Information & Data Collection

We collect information across our digital properties to facilitate secure business solutions, tax preparation, and bookkeeping services:

  • Website & Comment Data: When visitors leave comments on our sites, we collect the data shown in the comments form, along with the visitor’s IP address and browser user agent string to assist with automated spam detection.
  • Financial & Business Records: When engaging our professional services, we collect comprehensive business documentation, including bank statements, ledgers, tax IDs, incorporation documents, and Personally Identifiable Information (PII) required for financial management. All client records are treated with strict professional confidentiality and kept entirely separate from public-facing website data.

3. Document Uploads & Security

  • Client Portal & Financial Files: Documents uploaded securely via our encrypted client portal are restricted to authorized accounting professionals bound by strict confidentiality agreements.
  • Website Media: If you upload images to our public websites, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images published on the site.

4. Data Transmission Security

Protecting your sensitive financial records during transit is a top priority:

  • Encryption in Transit: All data transmitted between your device, our public websites (publidu.com and insigniabg.com), and our secure client portals is protected using industry-standard Transport Layer Security (TLS 1.3) encryption.
  • Secure Communications: Standard email is inherently insecure and susceptible to interception. We strictly require clients to use our encrypted client portal, secure file-sharing links, or encrypted messaging channels for transmitting Personally Identifiable Information (PII), bank credentials, tax documents, and financial statements. Publidu assumes no liability for data compromised when clients transmit sensitive information via unencrypted, public email channels against our security guidelines.

5. Cookies & Analytics

We utilize cookies to enhance user experience, secure our platform, and manage user sessions across both publidu.com and insigniabg.com:

  • Comments: If you leave a comment on our sites, you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies last for one year.
  • Client Portal Login: If you visit our client portal login page, we set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
  • Account Sessions: When you log in, we set up several cookies to save your login information and screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. • Auto-Logout Security: All active client portal sessions automatically log out after periods of inactivity to ensure the absolute confidentiality of your financial records.

6. Third-Party Tools & Services

Articles and pages on our sites may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

  • These third-party websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content.
  • When integrated with our financial operations, third-party platforms adhere to strict privacy standards and only process data strictly required to perform financial processing, invoicing, and reporting for your business. Visitor comments and form submissions may also be checked through automated spam detection services.

7. Data Sharing, Confidentiality & Password Resets

  • If you request a password reset, your IP address will be included in the reset email.
  • We do not sell, trade, or rent your financial data or personal information. Data is only shared with vetted professional partners or regulatory authorities when strictly required to fulfill your contracted business solutions or comply with legal obligations.

8. SMS, Phone Calls & Communications

To coordinate bookkeeping appointments, deliver urgent document requests, and provide administrative updates, we may contact you via telephone or SMS text messaging.

  • Consent & Opt-In: By providing your mobile phone number during onboarding or via our web forms across either of our domains, you explicitly consent to receive transactional and operational communications from Publidu.
  • Strict Confidentiality of Phone Data: We never sell, rent, share, or transfer your mobile phone number, SMS opt-in data, or communication consent to any third parties, affiliates, or lead generation networks.
  • Opt-Out Rights: You can revoke consent for SMS messaging at any time by replying STOP to any text message you receive from us, or by contacting us directly. Standard messaging and data rates may apply.

9. Data Retention

  • Website Data: If you leave a comment, the comment and its metadata are retained indefinitely. This allows us to recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
  • Client Financial Records: For registered client accounts, we store profile details and financial source documents provided during onboarding and throughout our engagement. In compliance with financial regulations and tax laws, financial records and working papers are retained for a minimum of 7 years before undergoing secure digital sanitization and physical cross-shredding.

10. Your Privacy Rights

If you have an account on our sites, have engaged our services, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you.

Note: This erasure request does not include any data we are legally, administratively, or securely obliged to keep (such as historical tax records, bookkeeping logs, and financial audit trails required by law or professional liability standards).

PART II: REFUND & CANCELLATION POLICY

1. Strict No-Refund Baseline

Because our bookkeeping and business solutions involve highly specialized professional labor, immediate allocation of certified resources, and irrevocable time spent analyzing and reconciling records, our financial policies are strictly enforced: All retainers, subscription payments, project deposits, and hourly billing fees are strictly non-refundable once paid or billed.

2. Monthly Subscriptions & Retainers

  • Recurring bookkeeping services are billed in advance on the 1st of each month.
  • Clients may cancel future billing cycles by providing a minimum of 30 days written notice.
  • No prorated or partial refunds are issued for mid-month cancellations or underutilized months resulting from client delays in submitting documents.

3. Project Deposits & Deliverables

  • Custom business solutions or historical clean-up projects require a non-refundable upfront deposit (typically 50%) before work begins.
  • Once a project milestone or final deliverable is completed and handed over, no refunds will be granted under any circumstances.

4. Client Abandonment

If a client fails to provide necessary source documentation for 60 consecutive days, the engagement is considered abandoned, all prepayments and deposits are forfeited to compensate for reserved firm capacity, and re-engaging will require a new contract and onboarding fee.

5. Waiver of Chargebacks

By engaging Publidu, you agree to resolve billing inquiries directly with our management in writing within 10 business days of the invoice date and explicitly waive the right to initiate ungrounded credit card chargebacks or bank disputes for services rendered or reserved professional capacity.

PART III: TERMS OF SERVICE

1. Acceptance of Terms

By accessing publidu.com, insigniabg.com, our client portal, or by retaining Publidu for professional bookkeeping and business solutions, you agree to be bound by these Terms of Service. If you do not agree to all terms, you must not use our websites or engage our services.

2. Client Responsibilities & Data Accuracy

  • Accuracy of Information: You warrant that all financial documents, bank statements, receipts, and corporate data provided to Publidu are accurate, complete, and legally obtained.
  • Timely Submission: You are responsible for delivering required source documents by agreed-upon deadlines (typically the 5th of each month). Publidu is not liable for delayed tax filings, penalties, or inaccurate ledger reporting caused by late, missing, or fraudulent client data.
  • Review of Work: Clients are solely responsible for reviewing and approving all financial statements, reports, and tax filings prepared by Publidu. Final sign-off on tax returns and regulatory filings rests entirely with the business owner or authorized corporate officer.

3. Scope of Services & Limitations

  • Publidu provides professional bookkeeping, record-keeping, and operational business solutions. Unless explicitly stated in a separate written CPA engagement agreement, our services do not constitute a formal financial audit or legal tax counsel.
  • We rely on the data you supply and are not responsible for discovering internal fraud, embezzlement, or systemic malfeasance within your organization unless specifically contracted for forensic accounting.

4. Intellectual Property

All content, branding, logos, workflows, proprietary templates, and software configurations found on publidu.com and insigniabg.com are the exclusive property of Publidu and are protected by intellectual property laws. You may not copy, reproduce, or distribute our proprietary materials without express written permission.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Publidu, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, or business interruption—arising out of or related to your use of our websites or professional services. Our total aggregate liability for any claim relating to our services shall not exceed the total fees actually paid by you to Publidu in the three (3) months preceding the claim.

6. Governing Law & Dispute Resolution

These Terms of Service, along with our Privacy and Refund policies, shall be governed by and construed in accordance with the laws of the jurisdiction in which Publidu operates, without regard to its conflict of law provisions. Any legal disputes arising from these terms must be resolved exclusively through binding arbitration or within the local courts of our primary jurisdiction.
